8. Warranties and Disclaimers
We warrant that services will be performed in a professional and workmanlike manner. However:
- Services are provided "as is" without additional warranties
- We do not guarantee specific business outcomes or results
- We are not responsible for third-party tools, services, or platforms
- Timelines are estimates and may vary based on project complexity
9. Limitation of Liability
To the fullest extent permitted by law, Kazzam Software shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the fees paid for services in the previous 12 months
10. Termination
Either party may terminate services with written notice. Upon termination:
- Client is responsible for payment of work completed
- We will provide work product developed up to the termination date
- Confidentiality obligations remain in effect
11. Indemnification
Client agrees to indemnify and hold harmless Kazzam Software from claims arising from client's use of services, violation of these terms, or infringement of third-party rights.
12. Governing Law
These terms are governed by the laws of the jurisdiction in which Kazzam Software operates, without regard to conflict of law provisions.
13. Dispute Resolution
Any disputes will first be addressed through good-faith negotiation. If unresolved, parties agree to binding arbitration before pursuing litigation.
14. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of services constitutes acceptance of modified terms.
15. Entire Agreement
These terms, together with any service agreements, constitute the entire agreement between parties and supersede all prior agreements and understandings.
